Cecati 1\/1 Tel. 0522-506307 \u2013 230274 email <a href=\"mailto:dpo@studiolegaleavvbaroni.it\"><strong>dpo@studiolegaleavvbaroni.it<\/strong><\/a><strong>, PEC: <\/strong><a href=\"mailto:clementina.baroni@ordineavvocatireggioemilia.it\"><strong>clementina.baroni@ordineavvocatireggioemilia.it<\/strong><\/a><strong>.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u2013 CATEGORIES OF DATA PROCESSED:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The Data subject to this processing are as follows:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>in the case of a natural person, personal identification data (such as, by way of example but not limited to, name, surname, place and date of birth, tax code, tel. no., email address, IBAN);<\/li>\n\n\n\n<li>in the case of a legal entity, the Data will be the company name or the name of the owner\/contact person of the company, email address, IBAN, name, surname of any contact persons and\/or representatives of the Client company.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>\u2013 PURPOSES OF PROCESSING AND LEGAL BASIS<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong> Your data will be processed for the following purposes:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>A)<\/strong> <strong><u>to fulfill legal obligations<\/u><\/strong> or obligations deriving from regulations, EU legislation, or an order from the Authority, including the communication of the same where necessary to fulfill the aforementioned legal obligations;<\/p>\n\n<p class=\"wp-block-paragraph\">\u2013 to exercise the Controller&#8217;s rights, e.g., the right of defense in court;<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>B)<\/strong> <strong><u>to fulfill any pre-contractual, contractual, and tax obligations<\/u><\/strong> deriving from existing relationships with You; in particular:<\/p>\n\n<p class=\"wp-block-paragraph\">\u2013 to enter into and execute the contract;<\/p>\n\n<p class=\"wp-block-paragraph\">\u2013 to provide after-sales assistance;<\/p>\n\n<p class=\"wp-block-paragraph\">\u2013 to prepare the Financial Statements or other documents relating to the activities carried out by the undersigned;<\/p>\n\n<p class=\"wp-block-paragraph\">\u2013 to fulfill other tasks that the law entrusts to the undersigned company.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>C) <a><u>Based on a legitimate interest<\/u>: <\/a><\/strong>Promotion of services, benefits, and similar (so-called soft spam: communications of a &#8220;direct marketing&#8221; nature to inform of promotions, benefits, particularly advantageous offer conditions in relation to the preferences\/purchases made by the customer).<\/p>\n\n<p class=\"wp-block-paragraph\">The processing of the data collected for the purpose referred to in <strong>point<\/strong> <strong>A)<\/strong> is justified by the contract to which you are a party (Art. 6(b) GDPR) and by the fulfillment of legal obligations by the Controller (Art. 6(c) GDPR). The legal basis for the data processing carried out for the purpose referred to in <strong>point C)<\/strong> is legitimate interest (Art. 6(f) GDPR). <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Mandatory or optional nature of data provision: <\/strong>the provision of Data for the purposes referred to in point A) is mandatory. In its absence, it would be impossible to fulfill the obligations provided for by law. Therefore, failure to provide the Data on your part would, in fact, make it impossible to follow up on the performance covered by the contract.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Data recipients<\/strong>: the data collected in relation to the indicated purpose may be communicated to public bodies and service companies or other private subjects who have a role in the management of such activities, to those appointed\/authorized by the Controller, to the data processors designated pursuant to Art. 28 of EU Reg. 2016\/679, and to IT consultants\/system administrators.  <\/p>\n\n<p class=\"wp-block-paragraph\">The updated list of processors and persons in charge of processing is kept at the Controller&#8217;s headquarters and you may access it at any time by means of a specific request to be sent to the addresses listed below.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>D<\/strong><strong>uration of processing<\/strong>: the data collected in relation to the aforementioned purpose will be stored until the termination, for any reason, of the business relationship or for the longer duration until the expiry of the ordinary statute of limitations for contractual liability, without prejudice to special needs for further data storage in relation to the contractual relationship that took place.<\/p>\n\n<p class=\"wp-block-paragraph\">At the end of the maximum storage period indicated therein, the personal data will be deleted.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Processing methods<\/strong>: the processing of data for the purposes set out above takes place via electronic, computer, or paper support in compliance with the rules of confidentiality and security provided for by the regulations referred to above and other subsequent regulations.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Transfer of data abroad: <\/strong>The data collected in relation to the aforementioned purposes are not transferred to countries outside the EU. The controller, however, reserves the possibility of using cloud services; in which case, the service providers will be selected from among those who provide adequate guarantees, as provided for by Art. 46 of EU Regulation 2016\/679.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Automated decision-making processes: <\/strong>the data collected in relation to the aforementioned purpose are not subject to automated decision-making processes (including profiling).<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Rights of the data subject: <\/strong>pursuant to EU Reg. 2016\/679, the data subject has the right to <\/p>\n\n<ul class=\"wp-block-list\">\n<li>access personal data to know (&#8220;reactive transparency&#8221;) the purposes of the processing, the categories of personal data collected, the recipients of the data communication, in particular if recipients in third countries or international organizations, the planned data storage period (Art. 15);<\/li>\n\n\n\n<li>obtain rectification (Art. 16);<\/li>\n\n\n\n<li>the right to obtain the erasure of personal data, if these are no longer necessary in relation to the purposes for which they were collected and if there are no further legal storage requirements (Art. 17 GDPR);<\/li>\n\n\n\n<li>request the restriction of processing (Art. 18);<\/li>\n\n\n\n<li>request data portability (Art. 20);<\/li>\n\n\n\n<li>the right to object to the processing for reasons related to your particular situation (Art. 21 GDPR).
